I. E-COMMERCE OF FUNERARY URNS GENERAL CONDITIONS

  

ARTICLE 1 –SCOPE OF APPLICATION OF THE GENERAL CONDITIONS OF SALE

 

  • – The General Conditions of Sale govern all orders made by the customer on the website www.next-world-in-design.com.

The present clauses of the General Conditions of Sale apply in their own right to all eventual contractual and commercial relations between NEXT WORLD IN DESIGN and the customer, in exclusion of all other stipulations, such as, for example, those contained in the customer’s general conditions of purchase.

The present may not be contravened without the written and express permission of NEXT WORLD IN DESIGN.

 

2.2 – All orders made on the site www.next-world-in-design.com imply the customer’s acceptance, having stated their understanding, of the clauses included in the present General Conditions of Sale.

The click validating the order, has the value of “digital signature” and implies full and complete acceptance of the present General Conditions of Sale.

2.3 – NEXT WORLD IN DESIGN reserves the right to modify the present General Conditions of Sale at any moment. The new General Conditions of Sale will be applicable by law from the moment of their publishing online on the internet site www.next-world-in-design.com.

 

ARTICLE 2 –PRODUCT CONFORMITY

 

2.1- NEXT WORLD IN DESIGN will make every effort to ensure that the photographic representations of the products offered on the site www.next-world-in-design.com are as faithful as possible to the products delivered.

Nonetheless, in view of the digital presentation of products on the internet network, it is possible that the customer’s perception of the photographic representations of the NEXT WORLD IN DESIGN products may not correspond exactly to the products delivered. The site’s photos have no contractual value.

In this case, the customer may only return the product under the conditions set out in article 7 if they are a “consumer” in the sense of the applicable jurisprudence

2.2 – NEXT WORLD IN DESIGN may not be held responsible for damages and wear resulting from outdoor exposure and bad weather.

2.3 – It is expressly agreed between the parties that NEXT WORLD IN DESIGN shall not be held responsible for any reason or in any way, for the direct co-contracting party of NEXT WORLD IN DESIGN or by any eventual sub-purchaser, in particular due to hidden or apparent flaws which may affect the products sold.

 

ARTICLE 3 – PRICES

 

3.1 – All prices mentioned include tax and take into account the VAT rate in effect in France and applicable on the day of sale.

3.2 – Our prices include costs associated with packaging and preparation of orders, excluding delivery fees.

3.3 – Delivery fees remain the sole charge of the customer. These fees differ according to the country of destination and the “normal” or “express” delivery service chosen by the customer when placing the order on the site www.next-world-in-design.com.

3.4 – A special rate is applied to funerary sector professionals. The term “professional” excludes all physical persons and is limited to professionals exercising a funerary activity.

 

ARTICLE 4 – VALIDATION AND PAYMENT OF THE ORDER

 

4.1 – Validation of the order online by the customer and acceptance of the payment implies the signature and acceptance of all the operations carried out on the site www.next-world-in-design.com by the Customer, in application of articles 1316 and according to the Civil Code.

4.2 – The Customer declares that they have read and expressly understood the conditions of sale displayed on our site before validation of the order.

4.3 – Contractual information will be subject to confirmation by email sent to the email addressed provided by the Customer during registration to the site www.next-world-in-design.com.

4.4 –NEXT WORLD IN DESIGN reserves the right to cancel any order for which payment has not been validated by their bank or due to any other dispute regarding payment.

 

ARTICLE 5 – RIGHT OF WITHDRAWAL

 

5.1 – In accordance with articles L.121-20 and in agreement with the consumer code, the customer, who bears the quality of consumer under the applicable French jurisprudence is allowed a period of seven clear days to exercise their right of withdrawal without justification of their motivations, and without being subject to the payment of any penalties, with the exception of any delivery costs associated with the returned product.

5.2 – The seven working day periods runs from the moment of receipt of the merchandise.

5.3 – In order to be eligible for the right of withdrawal, products must be returned in their full and intact, original packaging and in perfect condition for resale.

5.4 – Any damaged product or product in damaged packaged will be neither reimbursed, nor taken back, nor exchanged.

5.5 – All returns must be signalled to NEXT WORLD IN DESIGN in advance and the product must be returned to the following address:

5.6 – The customer has the option of requesting a refund of the sums paid or an exchange for another product. The customer must indicate their choice at the same time as they complete the return of the product ordered.

5.7 – In the case of an exchange, the customer will be responsible for the redelivery fees, deducted of increased according to any eventual difference in price between the models being exchange, in particular those related to the size and weight of the product being redelivered.

5.8 – In the case of a refund, NEXT WORLD IN DESIGN will reimburse the customer, by bank transfer, within a delay of thirty days from reception of the returned product, with any eventual “return” delivery costs deducted.

 

ARTICLE 6 – FEEDBACK

 

6.1 – Our products are sent in perfect condition. On receipt of the package, the Customer must immediately verify the conformity of the product delivered.

6.2 – In the case of a damaged product or refused delivery, the Customer must obligatorily note their complaint on the delivery note under “handwritten reserves”. From this date, the customer must obligatorily send, within two business days, a registered and signed-for letter to the transporter in order to confirm these complaints.

6.3 – The customer must obligatorily send a registered and signed-for letter, within two business days of receipt, a copy of these complaints and documents to NEXT WORLD IN DESIGN in order to proceed to any exchange or refund procedures.

6.4 – Any product that is returned in a used condition, or not returned in its original packaging and any claim made outside of the aforementioned required time period will not be subject to any exchange or refund.

 

ARTICLE 7 – DELIVERY AND DELIVERY SCHEDULES

 

7.1 – It should be noted that delivery costs are the sole responsibility of the Customer. These fees depend on the address of the destination stated by the Customer during their registration to the site www.next-world-in-design.com, and the weight and size of the package.

It is expressly agreed that the Customer bears all risks associated with the delivery of the product ordered on the site www.next-world-in-design.com may not be held responsible, particularly in the case of deterioration or loss of the product ordered.

Products ordered will be delivered only upon receipt of the Customer’s signature or the signature of their duly designated representative having the right to receive packages in their name.

7.2 – For personalized products, it should be noted that manufacturing of all the NEXT WORLD IN DESIGN products ordered by the Customer will begin upon validation of the order by the latter.

NEXT WORLD IN DESIGN will endeavour to expedite the products ordered within the delay agreed in relation to the manufacturing time required for each product.

It is understood that this delay is purely indicative and does not take into account any event that may potentially interfere with the manufacturing of NEXT WORLD IN DESIGN products, such as any eventual stock shortages experienced by its own suppliers.

In the case that a NEXT WORLD IN DESIGN product that has been ordered is manifestly not manufactured within the indicative time period stated above, we will send an email to the Customer informing them of the manufacturing delay pertaining to the relevant product and will indicate a time period for the product’s expedition.

7.3 – Delivery of NEXT WORLD IN DESIGN products is usually undertaken by the companies Chronopost or TNT, whose delivery periods vary according to whether the customer has opted for a “normal” or “express” delivery.

The delivery schedules stated on the website www.next-world-in-design are purely indicative, and we cannot be in any way held responsible for any eventual delays in the delivery of the product.

When the customer is a “consumer” in the sense applicable under French jurisprudence, they will have the ability to revoke the order placed on the sitewww.next-world-in-design under the aforementioned conditions noted in article 5.1.

This revocation must be made in writing by way of a registered and signed-for letter.

We will have a period of thirty days from the reception of the registered and signed-for letter to reimburse the Customer, by bank transfer.

7.4 – Upon expedition of the NEXT WORLD IN DESIGN product ordered, we will send the Customer confirmation by email.

7.5 – Depending on the destination, certain formalities and custom taxes are applied. Additional fees associated with this will be the sole responsibility of the Customer.

ARTICLE 9 –TREATMENT AND PROTECTION OF PERSONAL DATA

 

9.1 – We engage to respect the confidentiality of the personal data transmitted by the customer on the site www.next-world-in-design.com and to treat them in accordance with rules set out in the Data Protection Law of 6 January 1978.

9.2 – The customer has the right to access the personal information gathered during registration or during the ordering process of a NEXT WORLD IN DESIGN product.

9.3 –The Customer may, at any time, by email, or by letter addressed to the address mentioned in article 5.5 of the present, request the modification or removal of their personal information.

 

ARTICLE 10 – VALIDITY OF THE PRESENT GENERAL CONDITIONS OF SALE

 

In the event that any of the dispositions of the General Conditions of Sale is declared null or deemed ineffective, all other dispositions will continue to apply.

 

ARTICLE 11 – APPLICABLE LAW/DISPUTES

 

11.1 – The General Conditions of Sale are governed by French law.

11.2 – In the event of any dispute or complaint, the Customer will notify NEXT WORLD IN DESIGN in the first instance in order to attempt to arrive at an amicable solution.

 

For this to be done, complaints should be addressed, by way of a registered and signed-for letter, to the following address:

We will endeavour to respond within a period of fifteen days from the reception of said letter.

 

11.3 – All eventual disputes between the Customer and us will fall under the legal jurisdictions of France.

Except in the case of any contrary legislative of regulatory disposition, all disputes, of any kind, being brought before the Tribunal de Grande Instance (Regional Court) and the Commercial Court for disputes arising between professionals.

 

ARTICLE 12 – OTHER

 

12.1 – Currency: in order to facilitate your purchase, we will make the following international currencies available to you:

Euro (EUR), American Dollar (USD) and Yen (JPY).

12.2- Normal and express delivery: for fast delivery of your order, we make it possible for you to choose your delivery schedule.

Normal – 4-6 days within Europe and 7-15 days for countries outside the European Community

Express – 2-3 days within Europe and 4-7 days for countries outside the European Community.

These delivery schedules are non-contractual and dependent on any eventual unexpected delays linked to the transporter or the customs authorities associated with the destination country
